These terms of use ("terms") govern your access to and use of thefrequentflier.com and any content, tools, or services we publish there (together, the "site"). Read them carefully. If you don't agree with them, don't use the site.
These terms work together with our privacy policy and our affiliate disclosure.
Who we are
The Frequent Flier is an independent aviation publication. In these terms, "The Frequent Flier," "we," "us," and "our" refer to the publication and its operator. The Frequent Flier is currently operated as an unincorporated individual project based in the United States; it is not yet a registered legal entity. If that changes, this page will be updated to identify the entity directly.
Acceptance
By accessing or using the site, you agree to these terms. If you are using the site on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
Eligibility
You must be at least 13 years old to use the site. If you are in the European Economic Area, the United Kingdom, or another jurisdiction with a higher minimum-age requirement for online services, you must meet that local requirement (typically 16 under the GDPR's child-specific provisions). The site is not directed at children under those ages.
What you can do
We grant you a limited, non-exclusive, non-transferable, revocable license to access the site for personal, non-commercial use, and to share individual articles or tool outputs with normal hyperlinks and brief, attributed excerpts. You may quote short, attributed excerpts of our editorial content for commentary, news reporting, criticism, or research, consistent with fair use.
What you can't do
Without our prior written permission, you may not:
- Reproduce, republish, or redistribute substantial portions of our editorial content.
- Scrape, crawl, or harvest the site or its tools using automated means beyond what
robots.txtpermits, or use any of our content or tool outputs to train, fine-tune, evaluate, or otherwise develop machine-learning or AI models. - Use any of our tools or data feeds to build a competing service, or to redistribute or resell our content or tool outputs.
- Reverse-engineer, decompile, or otherwise attempt to derive the source of any non-open-source part of the site.
- Interfere with the site's operation, attempt to gain unauthorized access, or probe for vulnerabilities outside a coordinated-disclosure context (which we welcome — email us first).
- Use the site for any unlawful purpose, or in any way that infringes another person's rights.
- Remove or obscure any copyright, trademark, or other proprietary notice.
Intellectual property
Our content
The site's editorial content — articles, analyses, photographs, charts, illustrations, and the original code and design of our tools — is owned by The Frequent Flier or licensed to us, and is protected by copyright and other intellectual-property laws.
Other people's marks
Airline names, airline and aircraft-manufacturer logos, frequent-flyer program names, IATA and ICAO airline and airport codes, ATA and ICAO aircraft type designators, and similar identifiers are trademarks or other identifiers of their respective owners. We use them descriptively, in their ordinary industry sense, to refer to the entities, programs, equipment, and routes they identify. The Frequent Flier is not affiliated with, endorsed by, sponsored by, or otherwise connected to any airline, manufacturer, frequent-flyer program, or regulator.
Submissions
The site may accept private reader feedback, including briefing reactions and optional notes. This is not a public comment system, and we do not guarantee that feedback will be read, answered, published, or acted on.
By submitting feedback or any other content through the site, you grant The Frequent Flier a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, publish, quote, edit, and display that content in connection with the site, our editorial work, and promotion of the site. You represent that you have the right to grant that license.
You may not submit anything unlawful, abusive, harassing, defamatory, obscene, spammy, misleading, infringing, or otherwise harmful, or anything that includes sensitive personal information about you or another person.
Tools and data: read this
We publish tools and data presentations including, but not limited to, FAA delay dashboards, fleet trackers, route data, and schedule maps. These are provided for general informational and editorial purposes only. They are not authoritative for flight planning, dispatch, safety-critical decisions, or any operational aviation use. Do not rely on them as a substitute for official sources, including airline or airport notices, NOTAMs, the FAA, or other civil aviation authorities.
Source data may be delayed, incomplete, inconsistent across providers, or wrong. We do our best to surface caveats inline, but we cannot warrant any specific output at any specific moment.
No warranty
The site, its content, and its tools are provided "as is" and "as available," without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties — including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability. We do not warrant that the site will be free of errors, secure, or continuously available, or that defects will be corrected.
Limitation of liability
To the fullest extent permitted by law, The Frequent Flier and any successor entity, and our principals, contractors, and service providers, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your use of the site, even if we have been advised of the possibility of such damages.
Our aggregate liability arising out of or related to these terms or the site, for all claims combined, will not exceed the greater of (a) one hundred US dollars ($100), or (b) the amounts you have paid us, if any, in the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless The Frequent Flier and its operator, contractors, and service providers from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these terms, your misuse of the site, or your violation of any law or third-party right.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Dispute resolution
Informal resolution first
Before filing a formal claim, you agree to contact us at hello@thefrequentflier.com with a brief description of the dispute and the relief you seek. We agree to do the same. The parties will negotiate in good faith for at least thirty (30) days before initiating formal proceedings.
Arbitration and class-action waiver
Any dispute that is not resolved informally will be resolved by binding individual arbitration seated in the State of Delaware, administered under the rules of a recognized arbitral provider, rather than in court. You and we waive any right to participate in a class action, class arbitration, or representative proceeding with respect to any dispute covered by these terms. Either party may still bring an individual claim in small-claims court if the dispute qualifies, and either party may seek injunctive relief in court for intellectual-property or confidentiality violations.
Termination
We may suspend or terminate your access to the site, in whole or in part, at any time and without notice, for any reason — including for any breach of these terms. The disclaimers, limitations of liability, indemnification obligations, governing-law clause, and dispute-resolution clauses survive any termination.
Changes to these terms
We may update these terms. The "last reviewed" date at the top will reflect the most recent revision. Material changes will be noted on the site for a reasonable period before they take effect. Your continued use of the site after a change becomes effective is your acceptance of the new terms.
Severability and entire agreement
If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect. These terms, together with the privacy policy and the affiliate disclosure, are the entire agreement between you and The Frequent Flier regarding the site, and supersede any prior agreements on the same subject.
